1. Overview

Welcome to skinstep.ee! The terms “we”, “us”, and “our” refer to Vitamion Estonia OÜ ("Skinstep"). We operate this website (skinstep.ee), including the information, content, features, tools, products, and services available on it (the “Services”). Our store is powered by Shopify, which provides the technical platform that enables us to offer the Services.

These Terms of Service, together with any policies referenced herein (the “Terms”), describe your rights and responsibilities when using the Services.

In these Terms, “you”, “your”, and "yours" refer to any natural person who accesses or uses the Services, including a visitor to the website, a customer who places an order, and, where applicable, the recipient of the ordered products.

Please read these Terms carefully, as they contain important information about your legal rights. Nothing in these Terms affects your statutory rights as a consumer under Estonian or EU law.

By visiting, accessing, or using the Services, you agree to be bound by these Terms, our Privacy Policy, our Shipping Policy, and our Refund Policy. If you do not agree to these Terms or any of these Policies, you should discontinue use of our Services.

2. Access to the Services and Eligibility

By accessing the Services or placing an order through our Shopify-powered website, you confirm that you are legally competent to enter into a binding contract under applicable law. Our products are intended for purchase by consumers who are at least 18 years of age.

The Services do not require user registration or the creation of a customer account. Purchases may be made using Shopify’s guest checkout functionality. By placing an order, you represent and warrant that you are acting on your own behalf, that the purchase is for personal consumer use, and that you meet the applicable age and legal requirements to purchase the products.

Minors may browse the Services; however, purchases may only be made by individuals who are legally permitted to do so. The Seller does not have the technical means to verify the age of customers and relies on the accuracy of the information provided at checkout.

To place an order, you are required to provide certain information, including your email address and billing, payment, and shipping details. You represent and warrant that all information provided during checkout is accurate, current, and complete, and that you are authorized to use the selected payment method.

3. Our Products

We make every effort to present our products accurately on our website. Product images are for illustrative purposes only. Actual product appearance, including packaging and colors, may vary slightly due to manufacturing changes or your device and display settings. Such differences do not affect your statutory rights under Estonian or EU law if the product does not correspond to its description.

We do not guarantee that a product will meet subjective personal expectations; however, all products must conform to their description, specifications, and applicable legal requirements. Nothing in these Terms limits your statutory rights concerning product conformity.

Product descriptions may be updated from time to time, but such updates do not affect orders that have already been placed. We may discontinue products or limit quantities offered at our discretion.

Our products are cosmetic products and not medical products or treatments. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Some of our products contain varying levels of Vitamin A and must be introduced to the skin gradually. By purchasing our products from our website, you acknowledge that proper use requires a step-up approach according to Environ’s recommended Vitamin STEP-UP SYSTEM™. To achieve the best results and maintain skin comfort, we encourage you to choose products that match your current skin tolerance and to follow the recommended usage instructions.

Please read all product instructions and warnings carefully. If you are unsure whether a product is suitable for your skin or if you experience an adverse reaction, consult a skincare professional.

4. Treatment Services Provided by Third-Party Service Providers

We may provide training, educational materials, and product-related information to independent skincare professionals (“Service Providers”) to support the correct use of our cosmetic products. Such training and materials are provided for informational purposes only and do not create any employment, agency, partnership, franchise, joint venture, or supervisory relationship between Skinstep and any Service Provider.

All skincare treatments and services performed by Service Providers are carried out independently and under the Service Provider’s own professional responsibility. We do not control, supervise, direct, or guarantee the methods, decisions, qualifications, conduct, or outcomes of any treatments or services provided by Service Providers, even if they use our products or have completed training or education provided by us.

Any references on the Services to specific Service Providers, clinics, practitioners, or professionals (including listings, profiles, contact details, or other promotional or informational content) are provided solely as a marketing and informational channel. Such references do not constitute a recommendation, endorsement, certification, or guarantee by Skinstep of any Service Provider or of the quality, safety, or outcome of any treatments or services they provide.

Consumers are solely responsible for selecting a Service Provider and for entering into any agreements directly with them. Any contractual relationship regarding treatments or services exists exclusively between the consumer and the Service Provider. Skinstep is not a party to, and assumes no responsibility for, any such agreements or for any acts or omissions of Service Providers.

Our responsibility is limited solely to the safety, quality, and conformity of the cosmetic products we sell, in accordance with applicable Estonian and EU consumer protection laws. Nothing in these Terms limits or excludes your statutory rights in relation to defective or non-conforming products.

5. Orders

When you place an order through the Store, you make an offer to purchase the selected products. Your order will be deemed accepted and the contract between the parties will be concluded only when we send you an order confirmation email. If we cannot accept your order for any reason, we will notify you and refund any payment made without delay.

Please review your order carefully before submitting it. You may cancel your order before it has been shipped. After delivery, cancellations and returns are handled in accordance with your statutory rights under Estonian and EU consumer law, as well as our Refund Policy, where it does not conflict with such rights.

Your purchases must be for your personal and household use only and not for resale or export.

6. Prices and Billing

Prices, discounts, and promotions are subject to change before an order is placed. The price charged for a product or service will be the price shown at checkout at the time of purchase and will be confirmed in your order confirmation email. All prices displayed in our store include applicable VAT unless explicitly stated otherwise. Delivery fees are shown separately at checkout.

Prices posted in our website may differ from prices offered in physical stores or third-party stores. Promotions offered from time to time may be subject to additional terms. In the event of a conflict between promotion terms and these Terms, the promotion terms will apply.

You agree to provide current, complete, and accurate purchase, payment, and contact information for all purchases made in our store and to update such information as needed so that we can process your orders and communicate with you. By providing payment details, you confirm that you are authorized to use the selected payment method and that the payment will be processed by the relevant payment service provider.

Payments processed in our Store may be handled by third-party payment service providers (such as Trustly or other providers displayed at checkout). These providers process payments in accordance with their own terms, conditions, and privacy policies. By completing a purchase, you acknowledge and agree that the relevant payment service provider is responsible for the payment transaction and that we are not liable for any errors, delays, or issues arising from the processing of payments by such third-party providers. Nothing in this section affects your statutory rights under Estonian or EU consumer law.

7. Shipping and Delivery

Shipping and delivery of products are described in our Shipping Policy.

We do not ship orders outside Estonia.

Delivery times provided in the Store are estimates and are not guaranteed. We are not responsible for delays caused by circumstances outside our reasonable control, such as disruptions by shipping carriers or other unforeseeable events. This does not affect your statutory rights as a consumer under Estonian and EU law.

If we fail to deliver your order within a reasonable time, you may request delivery within an additional reasonable period. If we still do not deliver within that time, you may cancel the contract and receive a refund in full.

Risk of loss and damage transfers to you only when you, or a person designated by you, physically receive the products.

If a shipment cannot be delivered due to an incorrect address provided by you, or because the parcel is not picked up within the carrier’s stated holding period, the parcel will be returned to us. In such cases, we will refund the cost of the products from your order. We will not refund the original delivery costs of that order or costs associated with the return.

8. Return and Refund

Return and refund of products are described in our Refund Policy.

Under Estonian and EU law, you have a statutory right as a consumer to withdraw from the contract for any product(s) you ordered from our website within 14 days from the date you received your order, without providing any reason.

To exercise this right, you must notify us of your decision to withdraw from the contract. You may fill out and submit the Refund Form on our website.

When you fill out and submit the Refund Form, you withdraw from the contract for this order, which was formed when you received the order confirmation email from us. Your right of withdrawal starts from the date you received your order.

The right of withdrawal applies if any seal on the product or its packaging has not been broken or tampered with. This allows us to ensure that the product(s) from your order are of a quality suitable for resale without compromising health and hygiene. If any seal on the product or its packaging has been broken or tampered with, the product cannot be returned.

You are responsible for returning the product(s) from your order, and you have 14 days from the date of your withdrawal to send them to us. Unless otherwise stated in our Refund Policy, you are responsible for all costs associated with the return.

You are responsible for the product(s) from your order, including any decrease in their value while they are in your possession and until we have received them. Make sure to pack them well, as we will not issue a refund for product(s) that arrive in a condition that makes them ineligible for a return.

Your refund will be processed in accordance with our Refund Policy and applicable to Estonian and EU laws. Nothing in these Terms limits your statutory rights regarding defective or non-conforming products.

9. Intellectual Property

Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof, are owned by Skinstep, its affiliates or licensors and are protected by applicable Estonian and EU intellectual property laws. All trademarks, brands, text, displays, images, graphics, video, audio, and the design, selection, and arrangement related to Environ and its products are owned by Environ Skin Care (Pty) Ltd.

You may use the Services only for your personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Except as expressly permitted in these Terms, no license or other rights are granted to you under any intellectual property owned by Skinstep, Environ Skin Care (Pty) Ltd, Shopify, or any third party.

Unauthorized use of the Services may violate Estonian and EU intellectual property laws. All rights not expressly granted herein are reserved by Skinstep and Environ Skin Care (Pty) Ltd.

Skinstep.ee’s names, logos, product names, service names, designs, and slogans are trademarks of Skinstep or its affiliates or licensors. You may not use such trademarks without prior written permission. Shopify’s trademarks are owned by Shopify. Other names, logos, and product or service names appearing on the Services are trademarks of their respective owners.

10. Optional Tools

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). Certain features of the Services may involve automated tools for analytics or marketing purposes, as described in our Privacy Policy.
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service. Nothing in these Terms limits the statutory rights of consumers under Estonian and EU law.

11. Third-Party Links

The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party. Nothing in these Terms limits the statutory rights of consumers under Estonian and EU law.

12. Relationship with Shopify

Skinstep.ee is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with skinstep.ee. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and skinstep.ee, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with skinstep.ee.

13. Privacy

All personal information we collect through the Services is processed in accordance with our Privacy Policy. Because our Store is hosted by Shopify, certain personal information is also processed by Shopify as our service provider. Shopify acts as our data processor and processes personal data only on our behalf and in accordance with the GDPR. You can read more about Shopify’s data practices in its Privacy Policy.

Personal information submitted through the Services may be transferred to Shopify and other service providers that help us operate our Store. Some of these providers may be located outside the European Economic Area. In such cases, all international data transfers are carried out in compliance with the GDPR, including through the use of Standard Contractual Clauses or other adequate safeguards.

Nothing in these Terms limits your rights under the GDPR or Estonian data protection law. For more information about your rights and how your personal data is processed, please review our Privacy Policy.

14. Feedback

If you submit, upload, post, email or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback for any purpose, including to operate, improve and promote the Services. This license does not apply to any personal data contained in your Feedback unless we have a lawful basis for processing such data under the GDPR.

You represent and warrant that: (i) you own or have all rights necessary to provide the Feedback; (ii) you have disclosed any compensation or incentives received in connection with providing the Feedback; and (iii) your Feedback complies with these Terms.

We are not obligated to keep your Feedback confidential, except to the extent that it contains personal data, which we will process in accordance with our Privacy Policy and applicable data protection laws. We are not required to provide compensation for any Feedback nor to respond to any Feedback.

We may monitor, edit, or remove Feedback that we consider to be unlawful, offensive, threatening, defamatory, obscene, infringing, or otherwise inappropriate, or that violates any third-party rights or these Terms.

You agree that your Feedback will not violate any third-party rights, including copyright, trademark, privacy, personality, or other proprietary rights. You also agree that your Feedback will not contain unlawful, defamatory, abusive, or obscene material, or contain any malware or code that may affect the operation of the Services. You must not mislead us or others regarding the origin of any Feedback. You are solely responsible for the accuracy and legality of the Feedback you provide. We assume no liability for Feedback posted by you or any third party.

15. Errors, Inaccuracies, and Omissions

Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any such errors and to update or change information at any time.

If an obvious and material error affects an order you have already placed, we will inform you as soon as reasonably possible. In such cases, we may cancel the order before dispatch and will refund any payment you have made in full without undue delay. Nothing in this section affects your statutory rights under Estonian or EU consumer law.

16. Prohibited Uses

You may access and use the Services only for lawful purposes. You may not use the Services in any way that:

(a) violates applicable Estonian or EU laws or regulations;
(b) infringes intellectual property rights or other rights of skinstep.ee or any third party;
(c) involves harassment, abuse, defamation, threatening behaviour, or other unlawful conduct toward any person;
(d) involves providing false or misleading information;
(e) involves uploading, transmitting, or distributing harmful, illegal, or infringing content;
(f) involves sending unauthorized commercial communications (“spam”);
(g) involves impersonating another person or misrepresenting your identity; or
(h) interferes with or disrupts the operation or security of the Services.

You also agree not to:

(a) upload or transmit malicious code or any other harmful technology;
(b) attempt to gain unauthorized access to the Services or related systems;
(c) collect personal data of other users without a legal basis;
(d) use automated tools (such as bots, crawlers, or scrapers) unless permitted by law;
(e) attempt to circumvent technical protection measures used by the Services.

We may restrict, suspend, or terminate your access to the Services if you materially violate these Terms or applicable law. Such measures will be reasonable and proportionate and will not affect your statutory rights as a consumer.

17. Termination

We may restrict or suspend your access to the Services if you materially breach these Terms or use the Services in an unlawful or harmful manner. Unless immediate action is required to prevent misuse or protect the security of the Services, we will provide you with reasonable notice before such measures take effect.

You will not be charged for any Services that are not provided after termination. Termination does not affect any rights and obligations that have arisen before the date of termination or any statutory consumer rights that continue to apply under Estonian or EU law.

The following sections will continue to apply after termination to the extent necessary to fulfil their purpose: Intellectual Property, Feedback, Limitation of Liability, Indemnification (as permitted by law), Severability, Entire Agreement, Governing Law, and Privacy.

18. Disclaimer of Warranties

The information presented on or through the Services is provided for general informational purposes only. While we aim to keep all information accurate and up to date, we cannot guarantee that all content on the Services is free from errors. Any reliance on such information is at your own discretion.

Nothing in these Terms excludes or limits the statutory rights of consumers under Estonian or EU law, including rights related to product conformity, legal guarantees, or remedies in the event of defective goods.

The Services are provided on an “as available” basis. We do not guarantee that access to the Services will be uninterrupted or error-free. However, this disclaimer does not affect any mandatory obligations we have under applicable consumer protection laws.

19. Limitation of Liability

Nothing in these Terms excludes or limits your statutory rights as a consumer under Estonian or EU law, including rights relating to product conformity, legal guarantees, remedies for defective or non-conforming products, or liability for damage caused by defective products.

To the extent permitted by applicable law, Skinstep shall not be liable for any loss or damage that is not caused by our breach of these Terms, our failure to exercise reasonable care and skill, or our violation of mandatory legal obligations. We are not liable for losses or damages that were not reasonably foreseeable at the time the contract was formed.

We are not liable for indirect or consequential losses, including loss of profit, loss of business, loss of data, or other purely economic losses, as our products and Services are intended solely for personal consumer use and not for commercial or professional purposes.

Individual skin reactions, sensitivities, allergies, or other skin responses may vary depending on personal factors. Except where caused by a defective product or our failure to comply with applicable law, Skinstep is not liable for such individual reactions or outcomes resulting from the use of cosmetic products in accordance with provided instructions.

Skinstep is not responsible for any treatments, services, advice, or outcomes provided by independent third-party Service Providers, including skincare professionals, clinics, or practitioners, even if such Service Providers use our products or are referenced on the Services. Any claims relating to treatments or services must be directed to the relevant Service Provider.

Nothing in this section limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Estonian or EU law.

20. Liability for Damages

You are responsible for any losses or damages suffered by Skinstep that result from your unlawful actions, your intentional misconduct, or your breach of these Terms. This responsibility applies only to losses that you could reasonably foresee at the time of the breach.

Nothing in this section requires you to indemnify or compensate Skinstep for losses that arise independently of your actions or that occur without your fault, nor does it affect your rights as a consumer under Estonian or EU law.

If a claim is brought against Skinstep as a result of your unlawful actions or intentional misconduct, we may handle the defence of such claim. We will inform you of any such matter to the extent required by law, and you agree to provide reasonable cooperation if requested.

21. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be applied only to the extent permitted by applicable Estonian and EU law. The unlawful or unenforceable part will be deemed removed from these Terms, and this will not affect the validity or enforceability of the remaining provisions. Nothing in this section affects your statutory rights as a consumer.

22. Waiver; Entire Agreement

The failure by us to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms of Service and the policies referenced herein constitute the agreement between you and us regarding the use of the Services. This clause does not limit or exclude any statutory rights you have under Estonian or EU consumer protection law, which prevail in case of conflict.

If any part of these Terms is unclear or ambiguous, it will be interpreted in accordance with applicable Estonian and EU consumer protection laws.

23. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations under these Terms to another company, provided that such transfer does not reduce your statutory rights as a consumer under Estonian or EU law. If such a transfer occurs, we will notify you in a manner appropriate for the nature of the change.

24. Disputes and Governing Law

Consumers may submit disputes to the competent consumer dispute resolution authority of their country of residence or to an alternative dispute resolution body. In Estonia, disputes may be submitted to the Consumer Disputes Committee operating under the Consumer Protection and Technical Regulatory Authority (Endla 10A, 10122 Tallinn, email: avaldus@komisjon.ee). These Terms shall be governed by the laws of Estonia. All disputes shall be resolved in the courts of Estonia. If these Terms are available in multiple languages, the Estonian-language version shall prevail in the event of any discrepancies.

25. Headings

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

26. Force Majeure

We are not liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by an event beyond our reasonable control (“Force Majeure Event”). Force Majeure Events include, but are not limited to, natural disasters, acts of government, epidemics, pandemics, wars, civil disturbances, strikes, lockouts, failures of third-party suppliers or carriers, interruptions in transportation or utility services, or any other events that could not reasonably have been foreseen or prevented.

If a Force Majeure Event affects the performance of our obligations, we will notify you as soon as reasonably possible. Our obligations will be suspended for the duration of the Force Majeure Event, and we will resume performance once the event has ended. This section does not affect your statutory rights under Estonian or EU consumer protection law.

27. Changes to Terms of Service

You can review the most current version of these Terms of Service at any time on this page.

We may update or modify these Terms from time to time. Any changes will apply only to future purchases and future use of the Services. We will notify you of any material changes in accordance with applicable law, and such changes will take effect on the date specified in the notice. If you continue to use the Services after the effective date of the updated Terms, you will be deemed to have accepted the changes. Nothing in this section affects your statutory rights under Estonian or EU consumer law.
